What the Historic NJ PFAS Settlement Means for Your Water Systems
PFAS accountability is accelerating in the Mid-Atlantic. New Jersey has secured nearly $2.5 billion in landmark settlements, while Pennsylvania, Maryland, and Delaware face rising legal action and regulatory enforcement. Suburban Testing Labs is the region’s trusted partner for defensible PFAS testing and regulatory compliance—helping you stay ahead of litigation and enforcement risks.
PFAS Lawsuits Are Rising in the Mid-Atlantic—Is Your Water System Prepared?
If you’re a public water supplier, engineer, or wastewater system operator in Pennsylvania, New Jersey, Maryland, or Delaware, one thing is clear: PFAS manufacturer enforcement is here—and is expanding.
Let’s break down what’s happening:
New Jersey: $2.5 Billion in Settlements—And Counting
In 2025 alone, New Jersey reached two massive settlements:
- $450 million from 3M in May 2025
- Up to $2 billion from DuPont, Chemours, and Corteva August, 4, 2025
These settlements will fund PFAS abatement and natural resource restoration, making it the largest environmental recovery in state history. It also sets the tone for regulators and courts nationwide: polluters must pay—and communities must act.
Pennsylvania: Lawsuits Mounting from All Angles
While Pennsylvania has not yet reached a PFAS settlement, multiple lawsuits are in motion:
- Penn State University (June 2024) sued manufacturers after detecting PFAS in raw water supplies across its campuses.
- Philadelphia Water Department (2022) sued 3M, DuPont, and others for contaminating city-owned properties and waterways.
- Aqua (2025) sued Arkema for negligently discharging PFAS into the Goose Creek in West Chester.
While these remain ongoing, the settled cases in New Jersey signal a commitment to source water protection, water treatment, and clean-up.
Maryland & Delaware: Next in Line
While Maryland and Delaware haven’t made headlines—yet—they are under increasing EPA scrutiny for PFAS reporting and monitoring compliance. Many utilities in these states fall under EPA Region 3 enforcement and are required to:
- Test for PFAS under UCMR5
- Prepare for the enforceable limits (4 ppt for PFOA and PFOS)
- Report results to consumers and regulators
