Standard Terms and Conditions for HealthGuard® Water Tests
Unless otherwise stated in a formal contract, services provided by Suburban Property Inspections, Inc. (SPI) are expressly limited to the terms and conditions stated herein.
Special Notes HealthGuard® water tests are designed to test your water for personal use. Sampling for certain contaminants requires the use of dangerous chemicals such as Hydrochloric Acid. Because of the dangers involved with the use of these chemicals in your home these preservatives have been omitted from the sampling kits.
Return Policy Sample kits are non-refundable, however, they may be transferred or sold to another party. Samples not sent back to us within one year may be processed with the current list of tests for that package.
Cancellation Policy All orders cancelled within 24 hours of a scheduled pickup may be subject to a cancellation fee.
Confidentiality Reports are provided only to Client or those designated by the Client unless otherwise required by law. Client agrees not to use report or data in any manner that may harm the reputation or business of SPI, or the testing laboratory, Suburban Testing Labs, Inc., Client may not publish the name of SPI, or the testing laboratory, Suburban Testing Labs, Inc., without written approval.
Acceptance of Samples If SPI determines that the sample will not yield valid data for any reason (including but not limited to sample preservation, improper sample containers, or samples that require modification of our normal procedures) samples will be analyzed and conditions noted on the report. If modification of our procedures is possible, fees for the modification will be determined. If Client agrees to the fees verbally or in writing the samples will be accepted and processed for the agreed upon fees.
Delivery of Samples Client is responsible for samples until they are received by SPI personnel. SPI is not responsible for samples that are rejected because of holding time or improper preservation or storage before samples are received by SPI personnel. SPI reserves the right to refuse to accept samples that are suspected of being hazardous. The remainder of samples found to be hazardous will be returned to Client for proper disposal. It is the responsibility of Client to label and meet all regulations on samples that are hazardous. Samples that are suspected of being non-potable water will not be analyzed and refunds may not be granted.
Contracts All contracts are subject to review and must be signed by corporate officer.
Rush Analysis Rush analysis is available but may be surcharged depending on the analysis. It is Client’s responsibility to inquire of such charges prior to submission of samples for analysis.
Litigation Client agrees to assume all costs associated with official requests for documents or testimony. SPI and Client waive the right to a trial by jury.
Indemnification SPI agrees to indemnify the client for gross negligence or misconduct on the part of SPI or its agents unless such negligence is a result of negligent or willful omissions on the part of Client. Client understands and agrees to limit the liability of SPI to the cost of services provided or the damages incurred, whichever is less. Client agrees to indemnify SPI for gross negligence or misconduct on the part of Client or its agents unless such gross negligence is a result of negligent or willful omissions on the part of SPI.
Warranty SPI warrants the accuracy of the results of samples as submitted, no other warranty or liability for the use of the result is expressed or implied.
Sample Containers SPI will provide containers upon request but reserves the right to charge a fee. Sample containers may contain materials that are harmful to children, the Client is responsible to ensure that sample containers are kept away from children at all times.
